120. HAULING ON MUNICIPAL
ROADS
All requests for commercial/industrial/contract hauling
shall be subject to a Road Use Agreement which shall include and not be
limited to the following guidelines:
- The Director of Operations of the Municipal District
of Smoky River No. 130 shall be notified 48 hours prior to commencement
and/or completion of the haul.
- The Municipal District of Smoky River No.
130 shall designate the route which shall be used.
- The user will be responsible for the cost of adequate
signing conveying the turning of trucks at all intersection points along
the designated haul routes.
- During inclement or adverse weather conditions,
hauls should be stopped until conditions have improved.
- The haul will be subject to any road ban restrictions
that may be implemented by the Municipal District.
- The user shall, except for normal maintenance,
maintain and keep the road surface in acceptable condition at all times.
- The user shall, at the discretion of the Municipal
District, provide dust control for a length of 200 m at any residence
along the designated haul route being used.
- All costs to repair any damage including loss of
gravel to roadways and bridges beyond that resulting from normal public
use will be charged back to the company requesting approval.
- The user agrees to indemnify and save harmless
the Municipal District of Smoky River No. 130 from any claims and/or
proceedings from third parties as a result of approval being granted
for the use of the said roadway(s).
- All loads are to be clearly identified with the
name of the owner and in the case of log hauls, the name of the mill
must be clearly identified.
A "Road Use Agreement", Form R, has to be
signed except for the hauling by ratepayers of cereal crops, fertilizer
and agricultural chemicals.
