100. APPROACHES AND CULVERTS

 

The Municipal District of Smoky River No. 130 shall provide one approach and/or culvert not exceeding 8 metres in length on each quarter section in the municipality. This shall be provided upon request by the landowner at no cost to the landowner. Material costs for new culverts exceeding 8 metres in length will be at the landowner’s expense.

The landowner shall be responsible for the costs of any additional approaches and/or culverts which are in addition to that provided in the paragraph above.

The Director of Operations and/or Road Foreman shall decide whether or not a culvert is needed or if fill is sufficient; with the landowner having the right to appeal to Council in the case of non-agreement.

Requests for changing approaches or culverts located on a parcel to another location may be carried out by the Municipality if cost is paid by the ratepayer unless deemed necessary by Council. However, the Director of Operations or Road Foreman may give approval to the landowner for relocating and/or altering an approach or culvert if costs are paid by said ratepayer.

Repairs to damages caused by exiting and entering private property using the culvert approaches shall be paid for by the landowner.

All costs associated with extensions to existing culverts including material, equipment and labour shall be at the expense of the landowner.
