ROAD USE AGREEMENT

FOR ROADWAYS AS LISTED:

 

 

I ____________________ of _________________________, hereinafter referred to as the USER hereby

agree to the following conditions/stipulations set out by the Municipal District of Smoky River No. 130. The following conditions will apply during the full duration of the haul. At the time of notification, arrangements will be made for a pre and post inspection of the haul road(s).

  1. The Director of Operations of the Municipal District of Smoky River No. 130 shall be notified 48 hours prior to commencement and/or completion of the haul.
  2. The Municipal District of Smoky River No. 130 shall designate the route which shall be used.
  3. The user will be responsible for the cost of adequate signing conveying the turning of trucks at all intersection points along the designated haul routes.
  4. During inclement or adverse weather conditions, hauls should be stopped until conditions have improved.
  5. The haul will be subject to any road ban restrictions that may be implemented by the Municipal District.
  6. The user shall, except for normal maintenance, maintain and keep the road surface in acceptable condition at all times.
  7. The user shall, at the discretion of the Municipal District, provide dust control for a length of 200 m at any residence along the designated haul route being used.
  8. All costs to repair any damage including loss of gravel to roadways and bridges beyond that resulting from normal public use will be charged back to the company requesting approval.
  9. The user agrees to indemnify and save harmless the Municipal District of Smoky River No. 130 from any claims and/or proceedings from third parties as a result of approval being granted for the use of the said roadway(s).
  10. All loads are to be clearly identified with the name of the owner and in the case of log hauls, the name of the mill must be clearly identified.
