AGREEMENT: For Use in Connection with Snowplowing on Private Property

THIS AGREEMENT made this ______ day of _______________, AD, 20___

BETWEEN

The Municipal District of Smoky River No. 130

(hereinafter called "the Municipality")

OF THE FIRST PART

and

________________________________ of _____________________, Alberta

(hereinafter called "the owner")

OF THE SECOND PART

WHEREAS the owner has requested that the Municipality plow snow on his road/land/field on:

upon the terms and subject to the condition herein stated.

WITNESSETH: That the Municipality and the Owner agree as follows:

1. The Municipality shall perform the said work at a contract price as may be determined by the Municipality at their discretion from time to time, payable by the Owner to the Municipality in advance.
1. The Owner agrees to clearly mark the route to be plowed so that the snow plow is not in danger of being damaged or of doing damage to property obscured by the snow.
2. The Owner represents that he is the owner of the said land and agrees to indemnify and save harmless the Municipality in respect of any claims or demands which may at any time hereinafter be brought against the Municipality or any employee of the Municipality performing the said work by any person, firm or corporation by reason of the performance of the said work.

IN WITNESS WHEREOF the Municipality has hereunto caused its corporate seal to be hereunto affixed attested under the hands of its proper officers in that behalf and the Owner has hereunto set his hand and seal the day and year first above written.
